Recovery of Attorney’s Fees
Understanding The Financial Side Of Your Divorce
Hiring an attorney to represent you during your case is the best way to put yourself in an advantageous position – while there may be some short-term cost-saving benefits to representing yourself, even other legal professionals hire outside counsel because they understand the benefits of having a third party unaffected by potential emotional snares that exist in any family law case. Depending on your financial situation, you may be able to fight to have your attorney’s fees covered in your final agreement and relieve the stress it could put on your bank account while still receiving the high-quality legal assistance you deserve.

How Can I Recover Attorney’s Fees?
Just because you are at a financially disadvantageous position doesn’t mean that you should be forced into having inferior representation in order to afford the representation you need to ensure that you aren’t backed into a corner during the negotiation process or while in court. Ohio Revised Code 3105.73 provides people a way to include attorney’s fees in the final agreement:
In an action for divorce, dissolution, legal separation, or annulment of marriage or an appeal of that action, a court may award all or part of reasonable attorney's fees and litigation expenses to either party if the court finds the award equitable. In determining whether an award is equitable, the court may consider the parties' marital assets and income, any award of temporary spousal support, the conduct of the parties, and any other relevant factors the court deems appropriate.
